2. When the Terms and Conditions Apply
These Terms and Conditions govern the relationship between you and Active Planet Safaris (hereafter referred to as "the Company"). They apply in the following situations:
- When booking a trip directly with us.
- When booking a trip through our authorized partners.
By booking a trip through any of these channels, you automatically agree to be bound by these Terms and Conditions. They outline your rights and responsibilities while booking and participating in our tours in Tanzania and Kenya.
3. Our Warranties and Representations
We warrant and represent that:
- We hold all necessary licenses and permits to organize and operate Kilimanjaro climbing expeditions and wildlife safaris in Tanzania. We have also verified the licenses of our partners in Kenya.
- We possess the relevant expertise and experience, having arranged travel for over 5,000 visitors to Tanzania and Kenya.
- All our Kilimanjaro guides, wildlife safari driver-guides, and travel consultants are professionally trained.
- The information we provide in marketing and advertising is accurate and not exaggerated.
- We are a tour operator based in Tanzania and act as a travel agency for destinations in Kenya.
- Your trip with Active Planet Safaris will positively impact the developing communities in our key destinations. We pay above-market-average salaries to our local employees and actively support community development projects in Tanzania, including the Serengeti De-Snaring Project of the Frankfurt Zoological Society.
- We adhere to strict "leave-no-trace" protocols to promote sustainable tourism in Tanzania and preserve its natural heritage for future generations.
4. Treatment of Your Personal Information
To arrange your expedition, we will require certain personal information, including your full name, age, nationality, passport details, dietary preferences, and medical particulars. This information may be shared with Tanzanian and Kenyan wildlife authorities for entry permits and with accommodation providers to ensure a comfortable stay.
5. Communications and Correspondence
To avoid travel scams, ensure all communications with us are through the following channels:
- Email: Only emails from the @activeplanetsafaris.com domain.
- Phone and WhatsApp: Only phone numbers listed on the Active Planet Safaris website.
- Online Chat: Available on our website.
Due to our proactive communication safeguards, we have never been impersonated or misrepresented by third parties. However, always exercise caution.
6. Booking and Payment Process
The booking process begins with an email or phone call to our offices. A personal travel consultant will be assigned to manage all communications, planning, and tour arrangements. Once details are confirmed, an invoice will be issued, and a deposit is required to secure your booking. Your booking is confirmed when the deposit is received, and full payment must be made 14 days before the tour's start date unless otherwise agreed. Late payments may result in cancellation, and deposit forfeiture per our cancellation policies.
Please note:
- All transaction-related charges, including banking commissions, must be covered by you.
- A 3.5% surcharge applies to all credit card payments.
- Incomplete payments must be settled upon arrival.
7. Participation of Minors
- Only individuals 18 years or older can book a wildlife adventure with Active Planet Safaris. Bookings for minors must be made by a parent, guardian, or legal custodian, who accepts these Terms and Conditions on the minor’s behalf.
- Minors must be accompanied and supervised by an adult at all times. The adult is responsible for the minor's conduct and any resulting damages.
- All bookings for minors are subject to our approval. The adult must secure all necessary permits and approvals for the minor's travel. We are not liable for any failures that prevent the minor's entry into Tanzania or Kenya.
8. Third-Party Bookings (Tour Leaders, Travel Agencies, and Other Travel Professionals)
If you are making a booking on behalf of others, you will be the primary contact and responsible for:
- Informing all participants of these Terms and Conditions and securing their consent.
- Completing payments on time.
- Communicating any changes to the itinerary and securing consent from all participants.
- Providing accurate information about participants.
If you cannot accept responsibility for the above, each participant should communicate and book with us individually.
9. Prices
Once your booking is confirmed, the price will not change, except in the unlikely event that the Tanzanian or Kenyan government increases park fees, taxes, or other tourism-related charges. If this occurs, you will be given two options:
- Cancel your tour and receive a refund in line with our cancellation policies.
- Agree to the price change and pay the difference.
10. Changes to the Itinerary
- Changes by the Client: Any changes to your itinerary will be free of charge if they do not incur additional costs. Any extra costs will be your responsibility.
- Changes by the Company: We strive to ensure your tour goes as planned, but circumstances beyond our control (e.g., poor weather) may require changes. We will inform you promptly of any such changes.
- Changes Due to Third Parties: We are not liable for delays, disruptions, damages, or losses caused by third parties, such as flight delays or force majeure events. You or your insurance provider will be responsible for any related expenses.
11. Changes to Travel Dates
If you need to change your travel dates after making a payment, inform us at least 60 days before the original start date. New dates must fall within one year of the original travel dates. Note that domestic carriers in Tanzania and Kenya do not reschedule flights, and hotels may apply penalties for date changes. You will be responsible for any additional costs.
12. Cancellations
Cancellation by the Client: Our cancellation policy is straightforward. While deposits are non-refundable, we offer vouchers for future travel if you need to postpone your trip.
Cancellation Fees:
- Up to 4 weeks before departure: 30% fee
- 4 to 2 weeks before departure: 50% fee
- 2 to 1 week before departure: 75% fee
- Less than 1 week before departure: 100% fee
- Cancellations within 24 hours of deposit payment will result in a $100 deduction per person, but this amount can be transferred to a future booking.
-- Cancellation by the Company: If we cancel your tour, you will receive a full refund of payments made. This refund will be the extent of our liability.
We recommend obtaining travel insurance to cover cancellations due to unforeseen circumstances.
13. Travel Documents, Visa, and Entry to Tanzania/Kenya
Ensure that your travel documents are in order:
- Your passport must be valid for at least six months beyond your entry date.
- You should obtain a visa for Tanzania. The fastest way is through the Tanzania Immigration Department's website.
- We provide general advice on visas, but you should consult the relevant embassies for the latest information.
- We are not liable if you are denied entry to Tanzania, Kenya, Uganda, or Rwanda.
14. Accommodation
- Hotel Accommodation: Prices for group departures include shared accommodation in double or twin rooms. If you prefer a single room, please inform us at the time of booking. Extra charges apply.
- Tented Accommodation on Mount Kilimanjaro: Our Kilimanjaro climbing packages include shared tented accommodation. If you prefer a single tent, inform us at the time of booking. Extra charges apply.
15. Fitness and Medical Information
It is your responsibility to assess your fitness and health for Kilimanjaro climbs or wildlife adventures. We recommend seeking a qualified medical opinion if you are unsure. We may request medical information and ask you to complete a medical form. Failure to provide this information may result in tour cancellation with applicable fees.
16. Travel Insurance
Travel insurance is mandatory for participation in our trips. Your insurance should cover emergency medical expenses, evacuation, cancellation, and other relevant risks. If you are climbing Mt. Kilimanjaro, ensure your insurance covers high-altitude trekking (up to 6,000 meters) and helicopter evacuation.
17. Vaccinations
We provide general, non-medical advice on required or recommended vaccinations for your visit. You should consult a licensed physician for specific medical advice.
18. Authority of Our Guides
It is mandatory to follow all safety instructions from our guides. The chief guide's decision on all matters during the expedition is final. If the chief guide believes your condition or actions are unsafe, they may require you to descend, with assistance provided.
19. Assumption of Risk
You acknowledge that adventure travel involves inherent risks, such as visiting remote areas with different standards of medical assistance. You accept full responsibility for these risks and release us from any claims arising from them.
20. Liability for Damaged or Destroyed Property
You will be charged for any willful damage or destruction of our property, such as tents, safari vehicles, or hired equipment. Any indemnification must be settled before your departure from Tanzania.
21. Liability for Accommodation Providers and Air Carriers
While we carefully select our partners, we cannot control their performance and are not responsible for your experience with them. Your relationship with hotels, lodges, and airlines is governed by their own terms and conditions.
22. Complaints
In the unlikely event of a problem during your trip, you must immediately notify your guide, driver, or another Company representative so we can address the issue. If your complaint is not resolved, you may contact the Active Planet Safaris head office. Failure to promptly report an issue may affect your right to claim compensation or reimbursement.
23. Governing Law
This Agreement is governed by the laws of the United Republic of Tanzania. Any disputes arising from it will be subject to the jurisdiction of Tanzanian courts.
24. Severability
If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue to be valid.
25. Entire Agreement
This document constitutes the entire agreement between you and the Company. No verbal representations made by the Company or its employees are binding unless expressly stated in these Terms and Conditions.
